                    BACKGROUND Frank Watt, Public Works Director, has been working with the owners of the Palisade Café 11.0 and the 357 Bar and Grill to establish outdoor dining areas (parklets) in the downtown. The intent is to not only attract more patrons and visitors, but to strengthen the “sense of place” for the downtown. Parklets have been defined as the “Next Big Tiny Idea in Urban Planning” (Zack Patton, Executive Director - Governing.com). In general terms it is the temporary conversion of public parking areas for sitting/dining areas. The intent from the Town’s perspective is to generate more foot traffic and interest in downtown area.

The parklets of approximately 9 feet by 25 feet would be placed in the parking area of the road surface extending out from the sidewalks during the warmer seasons of the year and removed during the colder months. Although the Public Works Department is responsible for the design, construction and placement of the structures, the participating businesses are responsible for providing the outdoor dining furniture and for the upkeep and day to day maintenance of the structures.

When the parklets are not in use, primarily during the winter months, the structures will be removed from the rights-of-way and stored for future use when the warmer temperatures return.

RESOLUTION TEXT WHEREAS, the Town of Palisade is the owner of the Third Street and Main Street rights-of-way; and WHEREAS, John Sabal and John Feurborn, owners of the businesses at 113 West Third Street and 235 South Main Street respectively are requesting the use of the rights-of-way for the use of outdoor dining; and WHEREAS, the Town of Palisade supports the efforts of the downtown businesses to attract customers, thereby creating a vibrant downtown; and WHEREAS, the Town of Palisade has constructed the parklet structures for the use of the businesses at 113 West Third and 235 South Main Street; and WHEREAS, the Town of Palisade understands that the purpose of this agreement is to establish a revocable license to John Sabal and John Feurborn for the use and occupation of the parklet structures constructed by the Town of Palisade in the public right of way for outdoor dining during the appropriate months of the year; and WHEREAS, the Town of Palisade understands, agrees with and accepts the terms and conditions stipulated under this agreement; NOW THEREFORE, BE IT RESOLVED THAT THE BOARD OF TRUSTEES FOR THE TOWN OF PALISADE, COLORADO THAT:

 The Board of Trustees for the Town of Palisade, Colorado hereby authorizes the Mayor of the Town of Palisade to sign the License Agreements between the Town of Palisade and John Sabal and John Feurborn respectively.
