Summary

                    An Ordinance of the Town of Palisade, Colorado, Amending the Zone District Map of the Town by Zoning Certain Property known as Lot 2 of the Grande River Replat (Parcel #2937-054-55-002) from PUD Planned Unit Development to HR Hospitality Retail.

This application is being submitted by the owner Stephen Smith to replace a portion of existing PUD Planned Unit Development zoning with HR Hospitality Retail zoning. The existing PUD includes the Smith property, a productive vineyard, and the Wine Country Inn. If the application is approved, the Wine Country Inn would retain the PUD zoning, while the adjoining vineyard owned by Stephen Smith would be changed to the HR. Land to the east, developed as the Grande River Winery, is also being considered for the Hospitality Retail zoning. The intent of the applicant/owner is to establish a single unified HR Hospitality Retail zoning for the existing vineyard and the adjoining property developed as the Grande River Winery.

The site was annexed into the Town of Palisade in 2007. (Ordinance 2007-10). The annexation included two separate land owners who combined efforts to annex the land and then zone it as a single PUD Planned Unit Development. The land now developed as the Wine Country Inn continues to be under separate ownership from the adjoining land that is the subject of this application.

The vineyard site, owned by Stephen Smith, was platted as Lot 2 of the Grande River Replat in 2008. The adjoining parcel to the east, developed as the Grande River Winery, was platted as Lot 1. Both lots were platted together as a single subdivision, although Lot 1, or the winery parcel, had been annexed into the Town eight years earlier (Ordinance 849). The assumption is that an error occurred in the zoning maps at that time to reflect the PUD zoning for the Grande River Winery, even though it was never a part of the PUD.

The Wine Country Inn was developed after the annexation and the PUD zoning was completed in 2007. The current application is to remove this property from the original PUD zoning and to rezone it to reflect the same HR zoning as the Grande River Winery. The PUD zoning in place for the Wine Country Inn would not be affected other than the removal of the adjoining vineyard, under the separate ownership, from the PUD boundaries.
